Terms and Conditions of Service
1. Terms and Governing Law
By accessing the website at http://www.brightprospectstutoring.com (hereafter ‘the Site’) you agree to be bound by these terms and conditions of service, and all applicable laws and regulations. You also agree it is your responsibility to comply with any other laws and regulations applicable in your own location or country. The materials contained on this Site (or provided to you in printed or electronic form) are protected by the relevant copyright and trademark law in force within the jurisdiction of the Courts of England and Wales. Unless you agree to observe these terms and conditions you are prohibited from using or accessing this Site.
2. Cancellations of Booked Lessons
Please ensure you give at least 24 hours' notice of your wish to cancel or re-schedule a lesson. The tutor will endeavor to do the same. Outside of the 24 hour period - where possible - lessons will be re-scheduled at a time agreed. Lessons changed/missed within 24 hours of the time booked will be charged in full. For block bookings paid in advance, these fees will be deducted from the block payment. The tutor will also provide 30 days minimum notice of lesson cessation, unless ill health prevents this.
2. Copyright
Unless otherwise stated, Caroline Goodman asserts her moral rights as copyright owner of all the materials on this Site, or provided to you in printed or electronic form, under the provisions of the Copyright, Designs and Patents Act 1988. Infringement of her rights as copyright owner may result in both a civil claim for damages and/or criminal prosecution.
3. Limits of User Licence
Accessing this Site grants you permission to view and download one copy of the materials or information for personal non-commercial use. This does not grant you any title, ownership or interest in the Site, its materials or software. You may not modify, copy or reproduce, or attempt to decompile or reverse engineer any software on the Site, nor remove any copyright notice or proprietory annotation.
You may not transfer the materials to anyone else, reproduce or “mirror” them on any other server or website, or in any printed or electronic format. Any violation of these restrictions or terms shall automatically terminate your right to use this Site.
The same limits and restrictions apply to all materials separately provided to you in printed or electronic form. Caroline Goodman may terminate your User Licence at any time without notice. Upon termination of this Licence you must immediately destroy any of her materials in your possession in whatever format.
4. Accuracy of materials
You appreciate that materials appearing on Caroline Goodman’s Site may include technical, typographical or photographic errors, which she may not have spotted or been able to correct. You accept that your use of the Site carries no warranty, express or implied, as to its accuracy, completeness or currency. Use of the Site is entirely at your own risk. As owner, Caroline Goodman reserves the right to change, update, alter, amend or otherwise deal with the materials on her Site without notice at any time. She gives no commitment as to when or how often she may do this.

You accept that Caroline Goodman has not reviewed all the links appearing on or linked to her Site, or mentioned in other materials provided to you, and is not responsible for the contents of any such links. The inclusion of any link carries no endorsement by her and you use such links entirely at your own risk.
6. Modifications to these Terms
Caroline Goodman may at any time, and without notice, revise these Terms and Conditions of Service for her Site. By using the Site or her materials in whatever printed or electronic form you are agreeing to be bound by the version current at the time of use.
7. Disclaimer
The materials on this Site (or otherwise provided to you) are provided on an ‘as is’ basis, without any admission of liability. Caroline Goodman makes no warranties, express or implied, about their fitness for a particular purpose. She makes no representations about the accuracy, reliability, likely exam results, success at school entry or otherwise, resulting from or relating to the use of the materials on this Site, or provided to you or any child in your care, control or sponsorship. Caroline Goodman makes no warranties or representations about the contents of any linked sites belonging to any third persons, or as to any actual or potential infringement of any intellectual property rights.
8. Limitations of Liability
In no event shall Caroline Goodman (or her suppliers or agents) be liable for any damages, including (but without limitation) damages for loss of profit or of data, or arising from business interruption (yours or hers) arising from the use, or inability to use, the materials on her Site or otherwise provided to you. This limitation applies even where she (or her duly authorised agent) has received written or oral notification of the possibility of such damage. You agree that she has no liability for any consequential or incidental loss or damage of this nature.
9. Governing Law
These Terms and Conditions are governed by and shall be construed in accordance with the laws of England and Wales, and you irrevocably submit to the exclusive jurisdiction of these Courts in the event of any dispute over your use of this Site or any materials otherwise provided to you, or in any sites linked to them.
